By visiting IvyBlue.com, you agree to the laws of the state of California, without regard to principles of conflict of laws, will govern these Terms and Conditions of use and any dispute of any sort that may arise between you and IvyBlue.com

Electronic Communications
When you visit IvyBlue.com or send emails to us, you are communicating with us electronically. By doing so, you consent to receive electronic communications from us in return.  We will communicate with you via email or by posting notices on the website. You consent that all agreements, notices, disclosures, etc. that we provide to you electronically satisfy any and all legal requirements that select communications be in writing.

Your Account
You can either register on our site if you are making a purchase, or check out as a guest. By registering you are initiating an account that only you may access. You may access your account by using your email address and a password that you have created. Only you will have access to this information. If you are signed up on our email list, this does not mean you are registered. To access your account in the future, click the "My Account" button in the header of any page and enter the e-mail address and password you created at checkout. (If you have not been through checkout, but would like to create an account, simply click on my account and follow the steps to create a new account.)

By using this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You therefore agree to accept responsibility for all activities that occur under your account. In order to make purchases on the site you will be required to provide personal details. For example, you must provide your real name, phone number, email address, and other requested information as indicated. Additionally, you will be required to provide payment details that are both valid and correct. Confirmation of identity, as referred to in the billing information section may need to be provided.

By making an offer to purchase merchandise, you authorize us to perform credit checks and where necessary, transmit or to obtain your credit card information or credit report information to or from third parties solely to authenticate your identity, to validate your credit/debit card, to obtain an initial credit card authorization and/or to authorize individual purchase transactions. Furthermore, you agree that we may use your personal information in order to conduct appropriate anti-fraud checks.

Shopping On Line
If you would like to add an item to your bag, simply click the “Add To Cart” button. That item is now in your cart, and will be indicated at the top of the page, along with the total of items in your cart (Items in your cart will not be bought until you have completed the checkout process.) If you wish to remove an item from your cart, click the remove button, under the item you wish to discard. To view what is in your cart at any time, click the "View Cart" button.

To purchase what you've selected, simply click on the “Proceed to Checkout” directly form the pop up box, or View Cart and proceed to checkout from your cart. You can use your login information to proceed or, if you would like check out as a guest.

Orders
All orders from IvyBlue.com are subject to acceptance and availability, and items in your shopping bag are not reserved and may be purchased by other customers, until such time you have completed the check out process and an order has been created for goods purchased.

Once your order has been placed successfully you will receive an order confirmation via email. In addition, a shipping confirmation e-mail will be sent once your order has been shipped. For your reference,this confirmation will include the tracking number for your package.
Your credit card is not charged until we ship your order. Your card is charged only for the items that we ship to you. Every shipment contains an invoice listing the charges made to your card for that shipment. Items we mark canceled or backordered are not charged to your card. You may check the status of your order by visiting the “Order Status” link at the top of any page. Once you login to your account using your email address and password, click on the “Order Status” link to view past orders and current orders that you have placed. Note: tracking number may not be visible.

Our goal is to provide you with complete, accurate and up-to-date information on our website. Unfortunately, it is not possible to ensure that any website is completely free of human or technological errors. IvyBlue.com may at any point in time, contain typographical mistakes, inaccuracies, or omissions, some of which may relate to pricing and availability, and some information may not be complete or current. We reserve the right to correct any errors, inaccuracies, or omissions – including after an order has been submitted – and to change or update information at any time without prior notice. Our sincerest apologies for any inconvenience this may cause.


Insurance and Delivery
IvyBlue.com insures each purchase during the time it is in transit until it is delivered to your specified delivery address. Orders over $1000 require a signature for goods delivered, at which point responsibility for your purchased goods passes to you. We strive to dispatch all orders within one business day for items in stock. For pre-order items, we will process and ship the items within one business day of receiving shipment from the manufacturer. Estimated delivery times are to be used as a guide only and commence from the date of dispatch.

Merchandise Availability
Merchandise availability on our website cannot be guaranteed, until your order has been processed. The site may not be able to account for low or out of stock merchandise. If merchandise is not available by the time your order processes, we will notify you of this via email.

Pricing
Except where otherwise noted, the list price displayed for products on our site represents the full retail price as suggested by the manufacturer/supplier, or estimated in accordance with standard industry practice. With respect to items sold by IvyBlue.com, we cannot confirm the price of an item until your order. However, we do NOT charge your credit card until after your order has entered the shipping process. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Discounts and promotions are good on in-stock, regular priced merchandise unless otherwise noted. All coupon codes exclude accessories (shoes, handbags, jewelry, etc).  Only one coupon code may be redeemed per order. Coupon codes may not be retroactively applied to orders that have already been processed. IvyBlue.com is happy to offer a sale price adjustment on items purchased up to seven days prior to the commencement date of a sale. All approved sale price adjustments will be credited to your account in the form of a store credit.

Payment
Payment can be made by Visa, MasterCard, American Express, Discover, PayPal, and any other methods that may be clearly advertised on the site. You confirm that the credit/debit card that is being used is yours or that you have been authorized by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorization by the card issuer.

Product Descriptions
IvyBlue.com attempts to be as accurate as possible. However, we do not warrant that product descriptions or other content of this site are completely error-free. If a product offered by IvyBlue.com is not as described, your sole remedy is to return it in unused condition.We have made every effort to display as accurately as possible the colors, sizing suggestions and details of our products that appear on the site. Any inconsistencies with a product and dissatisfaction can be returned for credit if in unused condition.

United States Shipping

  • Free Standard Service for orders over $100: USPS Priority (2 to 3 day) Service will be utilized. Although this is a very reliable service, it’s not guaranteed.  A flat rate of $4.95 will be charged for all orders valued at less than $100.
  • Express (2 Day) Service ($19.00): USPS Express (1 to 2 day) Service will be utilized.
  • Overnight Service ($30.00): FedEx, UPS or USPS will be used to fulfill these orders.
  • Items ship from multiple locations so orders me not ship together. No additional charges apply if multiple shipments apply.
  • Orders will ship within 24 business hours.
  • Shipments to Alaska, Hawaii and Puerto Rico: Please allow for an additional one to two days in shipping time.

 

International Shipping

  • Prices are listed and will be billed in US Dollar.
  • All international orders are shipped via USPS (United States Postal Service).
  • Orders will ship within 48 hours to ensure that all items ship together.
  • International customers are fully responsible for all applicable duties and taxes. Please contact your local Customs office for details on these charges.
  • Transit times are estimates and do not account for Customs delays.

USPS Priority International (6 to 10 business days*):

  • Canada: $16.00
  • All other countries: $25.00

USPS Global Express (3 to 5 business days*):

  • Canada: $23.00
  • All other countries: $35.00


Return Policy
Upon receipt of your order, please carefully inspect each item.  If there are any discrepancies, please contact us within 24 hours customerservice@ivyblue.com. All items shipped from IvyBlue.com include a copy of our return policy along with a return form at the bottom of the invoice. Please include this sheet and/or a copy of your original invoice along with the merchandise to be returned to allow easy identification and prompt processing.
 
All non-sale items and items purchased at less than 40% off the original price are eligible for a full refund. Returns for non-sale items must be postmarked within 14 days of receipt. .  Items purchased at 40% or more off of the original price are considered a final sale and may only be returned for an exchange or store credit. Returns for sale items must be postmarked within three business days of receipt. Any item purchased during a promotion that clearly states "final sale" can be returned for an exchange or store credit. 

Please ensure that the below conditions have been met for all returns:

  • Unworn
  • Unwashed
  • Unaltered
  • All original tags attached, if applicable
  • No visible wear and tear
  • Fill out the return authorization form included with your order

If a return is deemed not acceptable, IvyBlue.com will contact you. The customer is responsible for the return shipping cost. This does not apply if a return is a result of an error made by IvyBlue.com. Please e-mail any questions to returns@ivyblue.com.

Faulty Goods
Though IvyBlue.com takes time to carefully inspect each outgoing shipment, should a product arrive damaged or faulty please notify us within 72 hours of receiving your shipment. If you would like to exchange a faulty item instead of obtaining a refund, please be aware that we can only replace it for the same product in the same size, subject to availability. Where possible, we will offer to repair faulty merchandise.

No Commercial Use
This site is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products or services contained within this site. You may not use this site, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own site.
